Terms of Service
These Terms of Service ("Terms") govern your use of 916notary.com and the mobile notary dispatch services provided by 916 Notary ("we," "us," "our"). By using this site or our services, you agree to these Terms.
1. Services
916 Notary coordinates dispatch of California-commissioned mobile notaries public to perform notarial acts permitted under California law, including acknowledgments, jurats, oaths and affirmations, and copy certifications. We also coordinate apostille submissions to the California Secretary of State.
2. Not legal advice
A notary public is not authorized to practice law. Our notaries cannot draft documents, advise you on legal matters, or recommend which type of notarial act is appropriate for your document. If you need legal advice, please consult a licensed California attorney. Information on this website is for general informational purposes only and does not constitute legal advice.
3. Eligibility and requirements
To use our services, you must:
- Be at least 18 years old (or coordinate through a parent/guardian).
- Be physically and mentally capable of understanding the documents you are signing.
- Present a valid, current, government-issued photo ID as required by California Government Code §8202.
- Sign in the personal presence of the notary.
- Not be under duress, coercion, or undue influence.
We reserve the right to refuse service if these requirements are not met or if the notary determines, in their professional judgment, that the notarization cannot be completed lawfully.
4. Fees and payment
California notary fees are capped by statute at $15 per signature acknowledged or jurat. We also charge a travel fee and, where applicable, a service or coordination fee. Fees are quoted at booking and are due at the time of service unless other arrangements have been made (such as for title-company loan signings billed on net terms). Apostille services include the California Secretary of State filing fee of $26 per document, which is passed through at cost.
5. Cancellations and no-shows
You may cancel without charge up to 30 minutes before the scheduled appointment. Cancellations made after the notary has been dispatched, or no-shows at the appointment location, may be charged the travel fee. Loan-signing cancellations after document printing may also include a printing fee.
6. Document preparation
You are responsible for ensuring your documents are complete, accurate, and ready for notarization before the notary arrives. The notary cannot fill in blanks, choose the type of notarial act, or modify the document. Documents with material alterations, blank required fields, or apparent fraud will be refused.
7. Recording and journal entries
California notaries are required to maintain a sequential journal of every notarial act, including the signer's name, ID information, document type, date and time, and (for certain real-estate transactions) thumbprint. By using our services you consent to these legally required journal entries.
8. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to our services is limited to the fees paid by you for the specific service giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages. Our notaries carry errors-and-omissions insurance and California-required surety bonds; claims involving alleged notary misconduct should be directed to the notary's bonding company and the California Secretary of State.
9. Disclaimer of warranties
This website and our services are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Real-time map data, ETAs, and agent locations are illustrative and not guaranteed.
10. Third-party services
The site uses third-party services for hosting, mapping (Leaflet and CARTO basemaps), payments, and may include third-party advertising (Google AdSense). Your use of those services is governed by their respective terms.
11. Intellectual property
All site content, branding, design, source code, and trademarks are the property of 916 Notary or its licensors. You may not reproduce, modify, or distribute the content without written permission.
12. Governing law and venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or our services shall be brought exclusively in the state or federal courts located in Sacramento County, California.
13. Changes to these Terms
We may revise these Terms from time to time. Material changes will be reflected by updating the "Last updated" date at the top of this page. Your continued use of the site or services after a change indicates acceptance.
